Windrush Scheme: Compensation, Status Restoration & Lessons

The Windrush scandal exposed one of the most serious failures in UK immigration administration in modern history. Our Bolton immigration solicitors explain what happened, what remedies are available, and the lessons for today’s immigrants.

What Was the Windrush Scandal?

The Windrush generation — people from Caribbean Commonwealth countries who came to the UK between 1948 and 1971 — had the right to live in the UK indefinitely. However, due to the Home Office’s “hostile environment” policies and the destruction of their landing cards by the Home Office in 2010, thousands were wrongly detained, deported, lost jobs and were denied NHS treatment — despite having lived in the UK legally for decades.

The Windrush Compensation Scheme

Launched in 2019, the scheme provides compensation for those who suffered losses as a result of being wrongly treated as though they had no right to be in the UK. Eligible claimants (or their estates) can claim for: loss of employment, loss of housing, inability to access NHS care, being detained or deported, and the impact on mental and physical health. Claims can be made regardless of whether you are still alive — families of deceased affected individuals can claim on their behalf.

Windrush Documentation Scheme

This parallel scheme provides free documentation to confirm the immigration status of those in the Windrush cohort who do not have documented evidence of their right to remain. Applications can be made regardless of where you now live — including abroad.

Ongoing Issues

Despite the schemes, many eligible people have not received compensation and the scheme has been widely criticised for its slow processing and low initial offers. Our solicitors can assist you in making or challenging a Windrush compensation claim.
