The EUSS Deadline Has Passed — But Late Applications Are Still Possible
The main EUSS deadline was 30 June 2021. However, late applications are still accepted where there are reasonable grounds for missing the deadline. This includes cases involving children, those who were not aware of the requirement, and those who lacked the mental or physical capacity to apply in time.
Pre-Settled vs Settled Status
Settled Status (Indefinite Leave to Enter/Remain)
Granted to those who had lived in the UK continuously for 5 years or more by the date of application. This is equivalent to ILR and provides a permanent right to live and work in the UK.
Pre-Settled Status (5 Years’ Limited Leave)
Granted to those with less than 5 years’ continuous residence. Pre-settled status holders must apply to upgrade to settled status before their pre-settled status expires. Crucially, recent court rulings have confirmed that continuous absence from the UK can cause pre-settled status to lapse.
EUSS Appeals
If your EUSS application is refused, you have the right to appeal to the First-tier Tribunal (Immigration and Asylum Chamber).
