Immigration Tribunal Manchester: What to Expect at Your Hearing
Immigration tribunal hearings can be intimidating, particularly for those who have never been before a court or tribunal before. Our Bolton immigration solicitors — who regularly appear at the Immigration and Asylum Chamber in Manchester — explain what to expect.
Where Are Immigration Hearings Held?
Immigration appeals for Bolton residents are generally heard at the Manchester Immigration and Asylum Chamber, located at the Civil Justice Centre in Manchester city centre. Our solicitors regularly appear here. Some straightforward hearings may be conducted remotely by video link.
Who Will Be at the Hearing?
The hearing will be presided over by an Immigration Judge (a legally qualified tribunal judge). The Home Office will be represented by a Presenting Officer. You will have the opportunity to have a legal representative (solicitor or barrister) present, and an interpreter if you need one. The hearing is formal but less adversarial than a criminal court.
What Happens During the Hearing?
Most hearings follow a standard structure: (1) procedural matters (checking documents, legal issues); (2) examination-in-chief — your solicitor questions you to elicit evidence in support of your case; (3) cross-examination — the Home Office Presenting Officer questions you; (4) submissions — both sides make legal arguments; (5) judgment — sometimes given immediately, often reserved.
Tips for the Day
- Arrive early — find out in advance where the building is and allow extra time for security checks
- Bring all documents in an organised bundle
- Answer questions clearly and honestly
- If you do not understand a question, say so and ask for it to be repeated or clarified
- Your solicitor will guide you throughout — follow their lead
What If the Decision Goes Against You?
If the First-tier Tribunal dismisses your appeal, you may be able to appeal to the Upper Tribunal on a point of law. Your solicitor will advise on the prospects of a further appeal and whether permission should be sought.
